Publication of FDA Guidance Imminent

Two closely watched and highly debated labeling documents from FDA are likely to be published this summer.  One is a proposed rule defining healthy nutrient content claims, and the other is draft guidance on plant-based milk labeling. Currently both are being reviewed by the Office of Management and Budget (OMB). OMB typically has a standard review time of 90 days. The plant-based milk labeling issues have been discussed for some time and overlap with standards of identity for dairy. There may also be First Amendment issues embedded in this topic. FDA is also taking a fresh look at what “healthy” means and issued a request for information from stakeholders in 2016.  The Agency received thousands of conflicting comments including several urging FDA not to define or endorse the work “healthy” at all.
